Terms of Service

1. Acceptance

By creating an ARIA account or using our service, you agree to these Terms. If you don't agree, don't use the service.

2. The Service

ARIA AI is a software platform that uses artificial intelligence to respond to customer messages on WhatsApp, Instagram, and Facebook on your behalf, schedule appointments, and send reminders. You authorize ARIA to send and receive messages from your connected accounts.

3. Account & Eligibility

  • You must be at least 18 years old and operate a legitimate business
  • You're responsible for keeping your password secure
  • One account per person; no sharing logins
  • You must provide accurate business information

4. Pricing & Payment

Plans:

  • Starter: $300 one-time setup + $97/month
  • Growth: $300 one-time setup + $197/month
  • Pro: $300 one-time setup + $397/month

7-day free trial: All plans include a 7-day free trial. We capture your card upfront. If you don't cancel before the trial ends, your card is charged the setup fee + first month. After that, you're billed monthly until you cancel.

All payments are processed by Stripe. Prices shown in USD. Taxes may apply based on your location.

5. Cancellation & Refunds

  • Cancel anytime from your dashboard or by emailing us
  • Cancellation during the 7-day trial: no charge
  • Cancellation after a paid period: service continues until the end of that billing month
  • The $300 setup fee is non-refundable once setup is complete
  • Monthly subscription fees are non-refundable for the current month

6. Acceptable Use

You agree NOT to use ARIA to:

  • Send spam, harassment, illegal content, or unsolicited commercial messages
  • Impersonate others or deceive customers
  • Violate WhatsApp, Instagram, Facebook, or any platform's terms
  • Send messages to people who haven't opted in
  • Reverse-engineer, copy, or resell the service
  • Use the service for adult content, gambling, or regulated industries without prior approval

Violations may result in immediate suspension without refund.

7. AI-Generated Content

ARIA uses AI to generate responses to your customers. While we train ARIA on your business info to ensure accurate replies, AI can occasionally produce errors. You are responsible for reviewing your AI's outputs and correcting any inaccuracies. We are not liable for losses arising from incorrect AI-generated information.

8. Third-Party Platforms

ARIA integrates with Meta (Instagram, Facebook), WhatsApp via Twilio, Stripe, and others. We are not responsible for outages, policy changes, or data handling by these platforms. Your use of those platforms is subject to their own terms.

9. Your Data & Content

You retain ownership of your business data and customer conversations. You grant ARIA a license to process this data solely to provide the service. You can export or delete your data at any time.

10. Service Availability

We aim for 99.9% uptime but make no guarantees. Scheduled maintenance is announced in advance. Service interruptions due to third-party platforms (Meta, Twilio outages) are outside our control.

11. Limitation of Liability

ARIA is provided “as is”. To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid in the 3 months preceding the claim. We are not liable for indirect, consequential, or lost-profit damages.

12. Termination

We may suspend or terminate your account for any breach of these Terms, illegal use, non-payment, or at our reasonable discretion. You may terminate at any time.

13. Changes to Terms

We may update these Terms. Significant changes will be announced 30 days in advance via email. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the jurisdiction where ARIA is operated. Disputes will be resolved through good-faith negotiation first; if unresolved, by arbitration.
